Terms and Conditions for B-Course Scheduling Service

Effective Date: June 5, 2025

These Terms and Conditions ("Terms") govern your use of the B-Course Scheduling Service mobile application and web platform ("Service"), designed to facilitate the scheduling of trainings, workshops, and other events (collectively, "Events"). The Service is operated and owned by Gnarst B.V. ("Owner") registered with the Dutch Chamber of Commerce under KVK number 34202923. Events are organized by Hans van Wechem, Nadia Koolma, and Esther de Vries in the context of their therapeutic practice (collectively, “Organizers”). By accessing or using the bcourse Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

The terms "we," "us," and "our" refer to the creator(s) of the “Service”. "You" refers to you, as a user of the Service, whether as an Event organizer ("Organizer") or an individual enrolling in an Event ("Participant").

1. Description of Service
   The Owner provides the Service for Organizers to list, manage, and schedule their Events, and for Participants to find and enroll in these Events.

2. User Accounts
   To use certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
   You are responsible for safeguarding your account password and for any activities or actions under your account.

3. Privacy and Data Protection
   Our Commitment: We consider the privacy of our users paramount. Our Privacy Policy, which is an integral part of these Terms, explains how we collect, use, protect, and share your personal information and the data processed through the Service. Please review it carefully.
   
   Organizer Responsibility: Organizers are responsible for their own compliance with applicable data protection laws regarding the personal information of Participants they collect and manage through bcourse.
   
   Participant Data: Participants acknowledge that their enrollment data will be shared with the Organizer of the Event they enroll in.

4. Intellectual Property
   All rights, title, and interest in and to the Service and its content (excluding user-generated content), features, and functionality are and will remain the exclusive property of the Owner and its licensors. The Service is protected by copyright, trademark, and other laws.

5. Software Disclaimer and Limitation of Liability
   "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive to provide a reliable and effective service, the owner(s)/creator(s) of bcourse make no warranty that the Service will be uninterrupted, secure, error-free, or that defects will be corrected.
   
   Exemption from Liability: To the fullest extent permitted by applicable law, the owner(s)/creator(s) of bcourse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
   
   Your access to or use of or inability to access or use the Service;

   1. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party;

   2. Any errors, inaccuracies, or omissions in any content or information, or for any loss or damage incurred as a result of your use of any content or information that is posted, emailed, transmitted, or otherwise made available through the Service;

   3. Disputes, errors in scheduling, or any issues arising from the Events themselves, which are the sole responsibility of the Organizers and Participants.

   4. No Liability for Organizer/Participant Interactions: bcourse is a platform provider. We are not a party to any agreement or transaction between Organizers and Participants. We are not responsible for the quality, safety, or legality of Events, the truth or accuracy of listings, or the ability of Organizers or Participants to fulfill their obligations.

6. User Conduct
   You agree not to use the Service in any way that:

   1. Is unlawful, fraudulent, or harmful, or has any unlawful, fraudulent, or harmful purpose or effect.

   2. Transmits, or procures the sending of, any unsolicited or unauthorized advertising or promotional material (spam).

   3. Knowingly transmits any data, sends or uploads any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

7. Modifications to Terms
   We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

8. Termination
   We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

9. Governing Law
   These Terms shall be governed and construed in accordance with the laws of the Netherlands and the European Union, without regard to its conflict of law provisions.
